Should I legalize my company before developing my product?

I am about to work with a beverage developer to create my first beverage, it will take about a month or two to have a final protoype and the formula and logistics. I have not assembled a team, I plan to take that prototype and samples to investors and establish interest and pre-orders after that. Would it be wise to go ahead and create my companys identity legally before I do anything?


I was thinking this way the formulation and packaging rights are set up under my company, also keeping me seperate from my company in case my beverage made someone sick or a company makes an ill attempt to come after me for infringing on their rights..
