Do I have a legal case?

I've been suspened from my college and in the handbook it states "You have the right to have a hearing within 10 (ten) calendar days to review the circumstances of this Interim Suspension." The handbook also states that "If the interim suspension is not upheld, the accused student will immediately be reinstated. The student cannot be penalized for missing class and will be guaranteed the opportunity to make up academic work missed during the semester in which the suspension was imposed." Of course suspensions can be extended but they have not done so. It is day 11 and they have yet to even set a date. Do I have a case? I've already repeated asked for a case and they have told me they will contact me when a date is ready.
